Kimberley Lunetta is a trial lawyer and employment advisor skilled at helping clients avoid and navigate complex workplace challenges.
Taking a business-minded approach, she partners with in-house counsel and HR leaders to resolve disputes, strengthen compliance and promote effective workforce management. When necessary to enforce clients’ contractual and other rights, or to defend employers facing discrimination, retaliation and restrictive covenant claims, Kim litigates cases in federal and state courts through to bench and jury trials, and in FINRA, AAA and JAMS arbitrations, through to final awards.
Kim also serves as s a trusted counselor, advising employers on leave and accommodation issues, executive agreements and separations, and compliance with workplace laws. She also conducts litigation avoidance training for managers and HR professionals and handles internal investigations, often for companies in the financial services, life sciences, and consumer product industries.
Before becoming a lawyer, Kim was a financial advisor with a leading financial services firm. In that role, she gained a deep understanding of the issues broker dealers and other regulated financial services firms face, which she applies in crafting effective strategies for her clients.
Kimberley is very helpful on employment and contractual issues; she is tactical.
Experience
- Defeated a preliminary injunction motion in which the court found the non-solicitation provisions to be overly broad and unenforceable, and defeated claims for breach of fiduciary duty, aiding and abetting breach of fiduciary duty, and tortious interference.
- Defeated a preliminary injunction motion asserting violations of noncompetition, nonsolicitation and trade secret misappropriation claims for a national staffing firm.
- Prevailed at jury trial in federal court, defeating race and disability claims against a national communications provider.
- Defended a Fortune 100 financial services company in a FINRA arbitration seeking more than $20 million in discrimination damages.
- Secured a favorable outcome for an international investment bank in a FINRA arbitration over alleged reverse gender discrimination and $45 million in claimed damages.
- Prosecuted a breach of confidentiality agreement against a former bank executive, obtaining injunctive relief and full recovery of attorneys’ fees.
- Won multiple bench trials before a state agency defending against discrimination and retaliation claims for a national communications provider.
