Jonathan Wexler guides employers through the complex landscape of employment law.

He represents clients against claims brought in federal or state court, and before administrative agencies involving discrimination on the basis of gender, race, disability, age, and other protected characteristics, wage and hour disputes involving unpaid wages or overtime, failure to accommodate medical conditions, and wrongful discharge.

Jon partners with both in-house counsel and HR leaders to help their companies proactively manage risk. Clients rely on him for responsive, practical advice, often in real time, as they address sensitive personnel matters including employee discipline and discharge, independent contractor and exempt/nonexempt classifications, disability-related accommodations, and leave of absence issues. Jon also advises on employment agreements, separation agreements, mergers and acquisitions, plant closings/reductions-in-force, and restrictive covenant disputes.

With a background in human resources, Jon understands the urgent challenges his clients face daily. Known for his commercially-focused approach, he provides clients with timely solutions that balance their workforce goals with legal compliance.

Experience

  • Litigated and favorably settled a wage and hour class action in federal court in Massachusetts against a large travel company involving 2,200 employees, addressing novel issues related to computer boot-up time and overtime rate calculations.
  • Achieved the dismissal of a disability discrimination claim against a hedge fund at the NYC Commission on Human Rights.
  • Achieved the dismissal of a failure-to-accommodate claim against a tree-care company at the Colorado Civil Rights Division.
  • Resolved an ERISA complaint in federal court in New York involving unpaid benefit contributions and withdrawal liability for an HVAC company.
  • Settled an age, gender, and disability discrimination claim filed in New Jersey Superior Court against an accounting firm.
  • Resolved a claim for unpaid wages before the New York State Department of Labor on behalf of a substance abuse treatment agency.
