John Burke advises clients on patents, trademarks, copyrights and trade secrets, helping them identify, protect and use intellectual property to support business goals.

His work spans industries and company stages, from solo inventors and startups to private equity firms and mature businesses preparing for sale or public offering. Clients rely on John for full-cycle IP support, including invention mining, filing and prosecuting applications, and handling registration. He drafts IP employment and consulting agreements and works on licensing, technology transfer and due diligence in transactions involving intellectual property. Leveraging strong relationships with IP lawyers worldwide, John also assists with global IP portfolios strategies.

An experienced first-chair litigator, John represents IP clients in federal courts and before the ITC. He regularly appears before the PTAB and TTAB in contested proceedings and handles appeals in the Federal Circuit and other appellate courts.

With a degree in electrical engineering and experience at a semiconductor company, John brings valuable technical understanding to his legal work. His background allows him to engage directly with client technology and offer practical, business-focused advice.

Experience  

  • Achieved a complete defense victory and significant damages award for client in patent and false advertising case. Took over shortly before expert discovery, obtained summary judgment on all claims, invalidated opposing patent in Inter Partes Review, upheld results on appeal, and prevailed at jury trial.
  • Helped an inventor secure software-patent protection for her novel treatment platform and leverage it into substantial licensing and services agreements with major hospitals.
  • Support a private equity firm with all aspects of buy-side IP diligence across multiple roll-up transactions; identify and build out each acquisition’s IP portfolio to prepare for favorable exits.
  • Advise a dietary and nutritional supplement company on global trademark protection and enforcement strategy.
