With more than 30 years of experience, he brings perspective, flexibility and a problem-solving mindset to complex matters. Much of Tom’s work involves defending securities issuers, corporate directors and officers, and companies facing claims brought by the DOJ, SEC, CFTC or private litigants, generally involving alleged violations of federal securities laws or state fiduciary duties. He also represents clients in distributor and franchise disputes, intellectual property cases, commercial conflicts such as fraud or breach of contract, and corporate divorces.

Tom approaches litigation by first understanding the business and what his clients need to achieve. He keeps communication open throughout and adapts strategy as circumstances change. Clients rely on him to achieve practical outcomes, either by crafting innovative and creative solutions or through an aggressive litigation approach. Experience 

• Defend a large international banking institution in a series of securities cases involving the demise of a mutual fund and two related hedge funds. Damages sought in these matters exceed $400 million. The client is looking for an aggressive response to a variety of claims from private, corporate and individual investor litigants.
• Represented a tier-one defense contractor over a failed contract to retrofit fighter aircraft in a foreign, allied country. This case required melding US government contracting law, foreign defense appropriation law and engineering concepts for the defense platform involved. Damages sought were over $40 million.
• Advised a large international alcohol supplier in an antitrust suit involving state antitrust claims brought by alcohol distributors in East Coast states. Damages sought were $60 million.
• Represent large candy manufacturer in litigation in the United States and in an international arbitration in the Netherlands following a recall of over $40 million in candy manufactured in Juarez, Mexico.
