Sergio Molina is a member of the firm’s Complex Commercial Litigation group, representing domestic and international clients in business and financial disputes before civil and criminal courts and regulatory authorities.

Sergio’s practice centers on high stakes matters involving allegations of fraud, misappropriation of assets, financial misconduct, creditor claims and regulatory scrutiny, among other things. He guides clients from various industries facing significant financial and reputational risk throughout all stages of multimillion-dollar disputes—from pre-suit investigation through to trial and appeal. He draws on his interdisciplinary experience in private practice as a career litigator and his work with Florida’s Eleventh Judicial Circuit and the U.S. District Court for the Southern District of Florida to deliver practical, strategic solutions that minimize his clients’ exposure to risk and align with their business objectives.

In his commercial litigation practice, Sergio represents clients in disputes arising from complex business relationships, financial transactions, and commercial ventures. He assists clients in proceedings involving contracts, business torts, intellectual property, real property, asset forfeiture, and information privacy, including matters relating to financial institutions’ protection of sensitive client data, the enforcement of creditors’ rights and debt collection practices and claims of unfair competition, false advertising and related commercial misconduct.

In his government investigations and white collar criminal defense practice, Sergio represents companies and individuals in domestic and cross-border matters involving the United States Department of Justice (DOJ), the Securities and Exchange Commission (SEC) and other criminal law enforcement and civil regulatory authorities. He assists clients in trials, internal investigations, and corporate compliance reviews involving claims of mail and wire fraud, public corruption, bribery, extortion, and violations of the Foreign Corrupt Practices Act (FCPA) and the False Claims Act, among other sanctions regimes.

In his bankruptcy practice, Sergio represents creditors and other stakeholders in disputes arising under or relating to the Bankruptcy Code, including adversary proceedings involving exceptions to discharge, fraudulent transfers and competing claims to property and other assets. He regularly assists clients in preserving and enforcing debts in bankruptcy and other insolvency proceedings involving allegations of fraud, breach of fiduciary duty, and other misconduct by debtors.

Leveraging his native fluency in Spanish, Sergio serves the Firm’s Latin American clients both domestically and internationally. He has also provided pro bono representation to individuals from the region in immigration proceedings involving asylum claims and habeas petitions. In his personal time, Sergio educates legal professionals across Mexico on litigation skills and techniques in the United States. He is also an active advocate for the LGBTQIA+ community, promoting diversity and inclusion initiatives and publishing on the intersection of law, privacy, artificial intelligence, intellectual property and commerce and the ways they impact marginalized communities.

  • Represented a corporate client before a state appellate court in connection with the appeal of a final judgment interpreting a permanent injunction, resulting in reversal of the final judgment.
  • Represented individuals in federal district court in connection with their claims for breach of contract and fraudulent transfer, among other claims, against foreign business entities and individuals, resulting in judgment entered in the client’s favor following trial.
  • Represented individuals in state court in connection with their mortgage foreclosure claims against a property development company, resulting in judgment entered in the client’s favor following trial.
  • Represented a foreign nonprofit clerical association in bankruptcy court in connection with its fraud claims against a debtor seeking discharge, resulting in judgment entered in the client’s favor.
  • Represented a trust in state court and bankruptcy court in connection with its claims against the estate of a former trustee and related co‑conspirators for breach of fiduciary duty, violations of Florida’s Trust Code and LLC Act, conversion, civil theft, and fraud, among other claims, resulting in settlement.
  • Represented a corporate client and its individual members in federal district court and on appeal in connection with their claims against a foreign government for violations of international law arising from alleged expropriation of property.
  • Represented a media company in federal district court in connection with the defense of copyright infringement claims asserted by a photojournalist, resulting in settlement.
  • Represented an individual in federal district court in connection with the defense of trademark infringement and cybersquatting claims asserted by a business entity, resulting in settlement.
