Eric Hyla is a member of the Litigation group, representing clients in government investigations white collar matters, and complex commercial disputes with an emphasis on matters implicating the antitrust and securities laws and regulations.

He advises companies and executives on DOJ, FTC, SEC, and FINRA inquiries, defends against high-stakes consumer class actions, and represents clients in intellectual property, consumer financial services, and general commercial litigation matters, helping clients manage risk and achieve favorable outcomes.

Eric additionally is experienced in counseling clients contemplating or engaged in mergers and acquisitions on antitrust issues throughout the transaction, including conducting pre-transaction risk analysis, navigating HSR filings and investigations, and monitoring for gun-jumping concerns prior to close. Eric has advised clients in the satellite telecommunications, transportation, oil and gas, pharmaceutical equipment manufacturing, and healthcare information services industries.

Eric is committed to pro bono service, securing DNA testing that prevented the execution of a wrongfully convicted individual with an intellectual disability and obtaining compensation for a military veteran who was wrongfully detained.

Experience

  • Defending a poultry producer in sprawling antitrust class action litigations against allegations of participation in supply reduction, bid rigging, and price fixing hub-and-spoke conspiracies for broiler chicken and turkey products.
  • Defending a financial institution in a several related complex litigations involving the demise of a mutual fund.
  • Defended a multinational bank in a $3 billion antitrust class action litigation alleging a price fixing conspiracy for GSE bonds entering the secondary market.
  • Represented multiple financial institutions in the investigations stemming from the SEC off-channel communications sweep.
  • Provided anti-gun jumping advice to national convenience store chain and its integrated fuel transportation business in connection with the sale of its business to a competitor
  • Obtained merger clearance after an HSR second request for a helicopter transportation company
